Restitution Program Information
In 2016, the First Judicial District Court for Santa Fe County, New Mexico entered a Final Judgment in the FastBucks case. The Court concluded that the FastBucks defendants should pay restitution to consumer borrowers who were identified in the consumer loan data the FastBucks defendants provided to the State and were adversely affected by the business practices at issue. The State later recovered funds through related proceedings and negotiated agreements, and those recovered funds are being used for this restitution program, subject to final program rules, approved costs, banking or tax requirements, stale-payment handling, and other administrative adjustments.
Based on information provided by the New Mexico Department of Justice, approximately $964,000 in gross recovered funds is associated with this matter. No specific payment amount is promised. The net amount available for payments will be determined under the final program rules after approved administrative expenses and any required adjustments.
The New Mexico Department of Justice and EisnerAmper (the “Restitution Administrator”) are using available loan data, mailing records, email records, address research, and related information to identify people who may be eligible to request payment. Who May Be Eligible?
If you obtained one or more loans through FastBucks Holding Corporation between 2007 and 2016, you may be eligible for a restitution payment.
You may be eligible to receive a payment if program records show that you were a consumer borrower identified in the consumer loan data of the FastBucks defendants provided to the State and were adversely affected by the FastBucks business practices at issue.
If you received a Notice with a Claim ID Number, you should provide that Claim ID Number when filing a claim online or by mail. If you did not receive a Claim ID Number but believe you may be eligible, you may submit a Claim Form with additional loan information to verify that you were a borrower who was adversely affected by the FastBucks business practices at issue.
