1. What is this program about?
In 2016, the First Judicial District Court for Santa Fe County, New Mexico entered a Final Judgment in the FastBucks case. The Court concluded that the FastBucks defendants should pay restitution to consumer borrowers who were identified in the consumer loan data the FastBucks defendants provided to the State and were adversely affected by the business practices at issue. The State later recovered funds through related proceedings and negotiated agreements. Those recovered funds are being used for this restitution program, subject to final program rules, approved costs, banking or tax requirements, stale-payment handling, and other administrative adjustments.
The New Mexico Department of Justice and EisnerAmper (the “Restitution Administrator”) are using available loan data, mailing records, email records, address research, and related information to identify people who may be eligible to request payment. Receiving a Notice does not guarantee that you are owed a specific amount.
2. What funds are available for this program?
Based on information provided by the New Mexico Department of Justice, approximately
$964,000 in gross recovered funds is associated with this matter.
No specific payment amount is promised by this Program. The net amount available for payments will be determined under the final program rules after approved administrative expenses and any required adjustments.
3. Who may be eligible?
You may be eligible to receive a payment if program records show that you were a consumer borrower identified in the consumer loan data of the FastBucks defendants provided to the State and were adversely affected by the FastBucks business practices at issue.
If you received a Notice with a Claim ID Number, you should provide that Claim ID Number when filing a claim online or by mail. If you did not receive a Claim ID Number but believe you may be eligible, you may submit a Claim Form with additional loan information to verify that you were a borrower who was adversely affected by the FastBucks business practices at issue. The Administrator may contact you if additional information is needed to verify your identity, address, or authority to submit a claim.
How to Request Payment
4. How do I request a payment?
You must submit a claim by
November 24, 2026 to request payment. The fastest way to file is online
HERE using your Claim ID Number, if provided, or by filling out the postcard notice claim information page and returning it to the Restitution Administrator.
You may also complete and return a paper Claim Form by mail. Mailed Claim Forms must be postmarked by the deadline. Keep a copy of anything you submit. Do not file both online and by mail for the same claim.
5. How will my payment be calculated?
If you qualify and submit a valid claim, your payment will be calculated using the final distribution methodology and the information available in program records.
The distribution methodology may consider available loan-level data, net overpayment calculations, the number of valid claims, the amount of net funds available, minimum or maximum payment rules, and other approved program rules. The Administrator may contact you if additional information is needed.
6. Do I need supporting documents?
Usually no, if you received an assigned Claim ID Number. The program is intended to rely on existing records where possible.
If you file without an assigned Claim ID Number, additional information will need to be provided on your Claim Form to verify that you were a borrower who was adversely affected by the FastBucks business practices at issue. The Administrator may ask for additional information if your identity, address, representative authority, deceased-borrower status, or entitlement cannot be verified from available records. Do not send original loan documents or other sensitive information unless the Restitution Administrator specifically requests them.
7. Can I choose how I am paid?
Available payment methods are paper check, PayPal, Venmo, and Zelle. Checks will be mailed to the address provided with your claim. If you select PayPal, Venmo, or Zelle, you must provide the mobile phone number or email address associated with that payment method.
8. How do I update my contact information?
If you filed a claim, please keep your information up to date so notices and payments can reach you. If you need to correct your name, address, email, phone number, or payment method, you may update your information

9. What happens if I do nothing?
If you do nothing, you will not receive a payment from this program. Doing nothing does not by itself cause you to accept a restitution payment or release any legal rights you may otherwise have.

10. Is there a fee to participate?
No. You do not have to pay a fee to file a claim or receive a payment from this program. The Administrator will not ask you to pay money to release a payment.

11. What is the legal effect of accepting a payment? Read this section carefully before you accept, deposit, cash, or otherwise receive a restitution payment.
Acceptance of restitution through this program may be subject to NMSA 1978, Section 57-12-9, that states that “A person need not accept restitution . . . [but their] acceptance of restitution bars recovery of any damages in any action by [the consumer] or on [their] behalf against the same defendant on account of the same unlawful practice.” A person who accepts restitution through this program may be barred from recovering damages in an action brought by that person on their own behalf related to the business practices at issue or the entities at issue in this and related litigation. State of New Mexico v. Infinity Loans of Albuquerque, New Mexico, LLC, et al., D-101-CV-2021-00667 (1st Jud. Dist. Ct. May 15, 2023)). In other words, if you accept payment, you may no longer be able to sue these entities for damages, and your acceptance could be taken as agreement to this.
The legal effect of accepting a payment may depend on the source of funds, applicable law, and your individual circumstances. The Administrator and New Mexico Department of Justice cannot give you legal advice. If you have questions about how accepting payment may affect your rights, consult your own lawyer before accepting payment.
12. How will my information be used?
Information you provide will be used to verify eligibility, process your claim, communicate with you, issue payment if approved, perform reporting and reconciliation, and comply with applicable legal, tax, banking, or government requirements.
The Administrator may share information with the New Mexico Department of Justice, approved vendors, payment processors, tax-reporting vendors, banking institutions, courts, or other parties as necessary to administer the program.
13. Will accepting payment affect taxes, public benefits, or other obligations?
The Administrator cannot give tax, benefits, or financial advice. Depending on final program rules and payment amount, the program may be required to collect tax information, issue tax forms, or report payments.
If you have questions about taxes, bankruptcy, liens, public benefits, child support, garnishment, offsets, or other financial obligations, consult a qualified adviser or the appropriate agency.
14. When will payments be sent?
Approved payments are expected to begin during
April 2027, after claims are reviewed and required processing is complete. This schedule may change.
